  • Legal Gray Area: Sweepstakes casinos navigate a legal gray zone in online gambling

Sweepstakes Laws

Sweepstakes casinos in Michigan reflect local legal complexities rather than a national trend. With evolving regulations, states with legal gaps become crucial grounds for assessing risk and making strategic decisions. While the US online gaming industry continues to grow, understanding the legal gray areas surrounding sweepstakes is vital.

Michigan's Sweepstakes Dynamics: The Future of Sweepstakes in The US

Michigan experienced a significant development in its online gaming sector when Virtual Gaming Worlds(VGW), the company behind Luckyland Slots, Chumba Casino and Global Poker, announced the impending closure of its sweepstakes casino in the State by February 1, 2024.

This strategic decision followed the Michigan Attorney General's request to Golden Hearts Games to discontinue operations due to state law breaches. VGW's announcement comes just a few weeks after Golden Hearts Game was asked to suspend its operation in the state, which further caused a stir.  However, the AG and the Michigan Gaming Control Board (MGCB) have been tight-lipped on why Golden Hearts Games was shut down. The sector is now subject to heightened regulatory scrutiny, necessitating critical decisions.

However, recently, during an interview, Michigan’s Gaming Law Attorney stated that the departure of sweepstakes casinos from Michigan doesn't signal anything to come but rather an example of the state's narrow interpretation of its online gambling laws. He reemphasized that the raised regulatory scrutiny is driving the companies to leave.

What does this mean for Online Sweepstakes Casinos?

Online sweepstakes casinos are go-to options for players who want to enjoy the thrill of casinos in the United States, particularly in areas where internet gambling is not regulated. The sites are legal and let users play their favourite games and cash their winnings for real money. These sites use in-house virtual currencies such as Gold Coins and Sweep Coins, which players can use to explore games on the website. Sweepstakes casinos, in essence, allow fans to delve into casino games, offering up prospects to win real money and other enticing rewards. Gold Coins are used for gaming reasons only and have no monetary worth. As you play games, you can win Sweep coins, which have an economic value. They're also available through different offers or free giveaways.

Sweepstakes casinos, unlike typical internet gaming, exist in a legal limbo. Because they are marketed as contests rather than pure gambling, most US states consider them lawful.

However, even though they are not real money casinos, they must follow state rules governing sweepstakes. Hence, when renowned brands are leaving the state due to regulations reasons, it raises a lot of suspicions as to whether these brands have been operating illegally. As regulatory scrutiny is now heightened in the state, it won’t be surprising to see more sweepstakes casinos fall victim to forced exit in the state and the country entirely.

The legality of playing at online casinos is sometimes questioned, and licenses from the proper authorising organisations are required for companies to operate lawfully in many countries worldwide. Sweepstakes casinos have been introduced, and they may frequently be utilised legally online without the requirement for formal authorisation.

Gaming Laws In the United States -Varied Interpretation

Sweepstakes have been a part of American society for decades, offering customers the chance to win huge rewards. Sweepstakes history in the country dates back to the early days of mail-in competitions, which were used as a marketing technique by businesses to raise brand recognition and drive sales.

Before the internet, entering sweepstakes was generally a time-consuming procedure that entailed filling out application forms and mailing them. Thankfully, it is considerably simpler nowadays, and a document may be quickly filled out and sent online. The ability to play sweepstakes online for money promotes accessibility by allowing users to enter more sweepstakes than ever before.

Sweepstakes are not considered gambling if they serve a genuine purpose and enable players to play for free. However, Michigan has a gaming statute which requires sweeps to be legally authorised by the state. However, there are different interpretations of gaming laws across the nation. Offering additional free play is interpreted as gambling in some states.

In some states, companies may be advised not to start operations due to how their sweepstakes laws are written. So, the firm will consider risk management, what counsel advises, and other essential criteria before setting up a business.  Top of the list is Washington and Idaho. Michigan is also following the path, particularly since the Michigan Gaming Control Board (MGCB) has already prohibited prop-style DFS wagering.
